It has often been suggested that the law of civil responsibility in West Africa is the same as the current English Law position on the subject. This book sets out to examining the basis of this assumption, an exercise which has never before been attempted by any previous writer in West African Law. The study is being divided into five major parts. In the first part, the meaning, scope and content of the title are fully discussed. The case for a new approach to the classification of obligations in Ghana and Nigeria is stated and argued. The law of obligations is substantially made up of case law. Chapters 2 and 3 of this part of therefore devoted to an examination of what cases bind which courts in both Ghana and Nigeria. Parts two and three are a two-tier study of contractual obligations, the former made up of two-party situations and the latter of more than two parties. In part four all the agreements that contain any vitiating element are examining under the heading of defective agreements. Part five it is a functional study of contractual obligations. Here in three chapters the role of the courts and the State in the enforcement of agreements and the effectiveness of remedies for the breach of agreements are examined. 366 pp, including general index ....
