He was born in England. His father was James Hume. When he was at the age of 3, the family moved to Dunedin, New Zealand, where he studied at Otago Boys' High School and took up law at the University of Otago. He passed the New Zealand bar examinations in 1885. Right after finishing his studies, Fergusson emigrated to Melbourne, Australia, where he became a barristers' clerk.
