"Statute of the Province of Canada Passed in the Sixteenth Year of the Reign of Her Majesty Queen Victoria and in the First Session of the Fourth Parliament of Canada Begun and holden at Quebec on the Nineteenth of August and Adjourned on the Tenth of November, 1852, to the Fourteenth February followng: Part Second. Reserved Act. His Excellency the Right Honourable James, Earl of Elgin and Kincardine, K.T. Governor General." Provincial declaration that Beresford's marriage is null and void. Beresford, of Toronto, married Emma Catherine Lawrence of Montreal in 1850. She deserted him for Daniel Gallagher, a servant, and were traced to Rochester, NY. In 1852 she gave birth to a female child that died. Beresford could no tinstitute legal proceedings against Gallagher since they lived abroad. He therefore applied to the Legislature for a divorce which was granted.
