Valdivieso then discovered that the accused had run off with an innocent young woman and had been living with her in poverty in Santiago. He sent the young woman to a decent home, assigned 15 days of community service to Rosa y Herrera, and released him on his own recognizance to return to his family. The next Valdivieso heard of him was when Rosa y Herrera published a scurrilous attack on him.Valdivieso (d. 1839), a lawyer, was named a judge in criminal court in 1828.
