About This Item

2013. ISBN-13: 9781584776895; ISBN-10: 1584776897. Farnham, Henry Philip. The Law of Waters and Water Rights: International, National, State, Municipal, and Individual Including Irrigation, Drainage and Municipal Water Supply. 3 Volumes. Originally published: Rochester: The Lawyers Cooperative Publishing Company, 1904. clxxx, 896; xvi, 897-1893; xiv, 1894-2956 pp. Reprinted 2006, 2013 by The Lawbook Exchange, Ltd. ISBN-13: 9781584776895; ISBN-10: 1584776897. Hardcover. New. $250. * This well-regarded treatise examines the relationship between states and nations, individuals and the public and between individuals. It also shows how these relationships determine water rights. This book has three parts: Part One: The Rights of States and Nations examines international rights and constitutional and statutory rights. Part Two: Rights Between Public and Individual, includes the public use of waterways, municipal water supply, drainage and rights of navigation. Part Three: Rights Between Individuals discusses the rights of riparian owners in watercourses, such as the right to dam a stream. Reprint of the sole edition. "[T]he author has properly divided the general subject of waters so as to show the rights depending on these different relations, and not, as is the usual method of division, on the mere characteristics of the body of water on or about which a particular right arises. As a general rule it is believed the production of legal works of large scope should be discouraged. With the exception of a few notable treatises the legal works covering broad subjects are now of little use to the practising lawyer. His needs are best met by the book which embraces a small field and in that field gives to the cases and principles a profound and careful examination and discussion. Mr. Farnham's comprehensive treatise must be regarded as a clear exception to the general rule.": J.M.B., Jr., Harvard Law Review 18 (1904-05):77-78. "He has certainly produced a most excellent book on a most interesting subject." -- F.E., Law Quarterly Review 20 (1904): 444. Henry Philip Farnham [1863-1929] is the author of many prominent works including The Lawyers Reports Annotated (1905). He was editor-in-chief of Ohio Jurisprudence (1928).
